Iceland EU Rejection Keeps Nation Outside MiCA Crypto Rules

Iceland Says No To EU Talks, Maintains Own Crypto Framework

In a referendum held on August 30, Iceland, traditionally known as a bitcoin mining hub, rejected a proposal that would have paved the way for talks seeking to become a member state of the European Union.

According to numbers reported by RÚV, the country’s official broadcaster, the No option garnered support from 52.8% of the voters (105,339 votes) in a close call that evidenced the divide between urban areas, which supported resuming integration talks, and rural communities, which rejected these moves.

A Yes option victory would have implied a new move by Icelandic authorities to resume talks to become a member state, a process the nation started in 2009 but froze without an official withdrawal to this day.

The rejection of these talks implies that Iceland retains its status as a member of the European Economic Area and a signatory of the Schengen Agreement. This means that, while maintaining close relationships with other European countries, Iceland remains outside the Markets in Crypto Assets (MiCA) framework umbrella.

However, this might change in the future, as upcoming changes in EEA states’ responsibilities might force Iceland’s hand in the crypto-regulation area.

Ella Nummelin, Corporate Administrative Intern at IBCCS TAX CY, stressed that, while cryptocurrency activities in Iceland are primarily governed through general-purpose financial laws rather than by a specialized framework, this might change in the future.

“As an EEA member rather than an EU Member State, Iceland is not automatically subject to MiCA. However, the regulation is widely expected to be incorporated into the EEA Agreement in the future, bringing Iceland into closer alignment with the broader European crypto regulatory framework,” Nunnelin stressed.

She highlighted that Iceland’s crypto laws have remained stable even as other European jurisdictions have moved to adapt to MiCA. “The main development to watch is the eventual incorporation of MiCA into the EEA Agreement, although no formal timeline has been announced,” she concluded.
