The Senate did not advance the Digital Asset Market Clarity Act on Tuesday, rejecting cloture on the motion to proceed by a vote of 49 to 50.
The measure needed 60 votes to overcome a procedural hurdle and fell 11 votes short.
Collins, Hawley, Moran, and Tillis broke with their party
Every yes vote came from a Republican. Four Republicans broke with their party to vote no: Maine’s Susan Collins, Missouri’s Josh Hawley, Kansas’s Jerry Moran, and North Carolina’s Thom Tillis.
No Democrat or independent supported the motion. Delaware’s Chris Coons did not cast a vote.
The vote came at 2:19 p.m. ET, recorded as Roll Call 234. A motion to proceed asks one question only: whether the Senate takes a bill up at all.
H.R. 3633 never cleared that step. No amendments, no vote on passage.
The bill would specify how oversight of digital commodities would be divided between the Securities and Exchange Commission and the Commodity Futures Trading Commission.
It would also prohibit Federal Reserve banks from offering products directly to individuals and prevent the use of a central bank digital currency in monetary policy.
Bitcoin funds took $160.04 million on Monday
Crypto funds had spent the previous session taking in money across every major category. Bitcoin funds pulled $160.04 million, and ether products another $121.02 million.
The bitcoin haul of $160.04 million reversed four straight sessions of redemptions last week. BlackRock’s IBIT did most of the work at $134.35 million.
Fidelity’s FBTC came in second with $53.33 million. Ark & 21Shares’ ARKB was in the red, losing $41.95 million.
SoSoValue put the bitcoin ETF trading value at $2.69 billion for the day. Net assets rose back above the $100 billion level to $100.09 billion after slipping below that mark in last week’s selling.
Ether funds continued their trend with a $121.02 million inflow, marking their second straight positive session. BlackRock’s ETHA led again with $80.50 million.
$XRP ETFs added $11.26 million, and it all went to Bitwise’s $XRP fund. Solana ETFs saw $11.01 million in inflows.
US spot bitcoin ETFs saw outflows of $462.7 million last week, the first weekly reversal after three straight weeks of inflows. Thursday alone saw $282.7 million leave, the largest single-day withdrawal since July.
BlackRock continued to buy. Arkham data revealed IBIT bought about $1.08 billion worth of bitcoin in the last 20 days, with inflows on seven of those days.
By comparison, GBTC sold a net $254.7 million during the same period.
