White House warns CLARITY Act will die Sept 15 unless 7 Democrats vote yes

The White House is raising pressure on Senate Democrats ahead of a Sept. 15 vote on the CLARITY Act, arguing that lawmakers have already had enough time to reach a deal on crypto market structure.

On Aug. 8, Patrick Witt, executive director of the Presidential Council of Advisors for Digital Assets, accused Senate Minority Leader Chuck Schumer and other Democrats of blocking the procedural vote on the bill before the August recess while seeking more time for negotiations.

Witt said Congress has spent years working on crypto market structure legislation and that the Senate has been negotiating the CLARITY Act since last summer.

He said:

“If they can’t get there by September 15, they never will.”

Republican Sen. Bernie Moreno echoed that message, framing the coming vote as a choice over whether the US maintains its lead in digital-asset innovation or cedes ground to countries such as China.

The pressure campaign follows Senate Majority Leader John Thune’s decision to file cloture on the motion to proceed to H.R. 3633, setting up a 2:15 p.m. vote on Sept. 15.

Notably, the upcoming vote would not pass the CLARITY Act. Instead, it would determine whether the Senate ends debate on the motion to proceed and begins formal consideration of the legislation.

Republicans say negotiations are over as seven Democratic votes become the target

That procedural step would still require 60 votes, leaving Republicans dependent on Democratic support to bring the CLARITY Act to the Senate floor.

In an X post, Moreno said he expects all 53 Senate Republicans to support cloture, meaning at least seven Democrats would need to vote yes for the legislation to advance.

Moreno also rejected the idea that lawmakers need more time to negotiate, saying there was “absolutely nothing” left to resolve because an agreement had been reached weeks ago.

He said 11 months of negotiations between Senate Republicans and Democrats had officially ended and that parties to the agreement would be expected to keep their commitments.

The position leaves the Sept. 15 vote less focused on whether lawmakers can reach another compromise and more on whether enough Democrats are prepared to support the one Republicans say has already been negotiated.

The Senate Banking Committee advanced the CLARITY Act 15-9 in May after nearly a year of bipartisan talks, with two Democrats joining Republicans. Negotiations continued afterward over issues including ethics restrictions for elected officials with crypto interests and stablecoin rewards.

Democrats have sought stronger conflict-of-interest safeguards involving government officials with digital-asset businesses, an issue that has grown more contentious because of President Donald Trump’s family crypto ventures. Banks and crypto companies have also clashed over whether platforms should be allowed to offer rewards on stablecoin balances.

Moreno maintains those disputes have now been settled.

If his prediction of unified Republican support holds, the Sept. 15 vote will come down to whether at least seven Democrats are willing to advance the bill.

Failure to invoke cloture would not formally kill CLARITY, but it would deepen doubts over whether Congress can assemble the bipartisan majority needed to pass market structure legislation this year.
